Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of FLEXMAX — the FLEXMAX mobile application, website, and related services (together, the “Service”). In these Terms, “FLEXMAX”, “we”, “us”, and “our” refer to the operator of the Service [operating entity and registered address to be finalized before public launch]. By creating an account, starting a free trial, or subscribing, you agree to these Terms. If you do not agree, do not use the Service.

1. The service

FLEXMAX is an independent, paid subscription tool for Amazon Flex drivers. When you enable it and set your filters — such as minimum pay per hour, pickup area, start time, and block duration — FLEXMAX searches for offered delivery blocks that match those filters and can automatically accept the ones you have asked it to catch. Block times are interpreted in your device’s own time zone.

FLEXMAX is sold as a flat monthly subscription with 0% commission. We do not take a percentage of your earnings or a per-block fee — you keep 100% of what you earn from the blocks you work. The Service is a tool that acts on your instructions; it does not employ you, dispatch work to you, or guarantee that any block will be available or accepted.

2. Eligibility

To use FLEXMAX you must:

• be at least 18 years old and able to form a binding contract;
• hold your own valid, active Amazon Flex driver account that you are authorized to use; and
• use the Service only in a market where it is offered — currently the United Kingdom, the United States and Canada.

You are responsible for meeting Amazon Flex’s own eligibility and program requirements. FLEXMAX does not create, verify, or manage your Amazon Flex account.

3. Your account

You are responsible for the credentials you use, for all activity under your FLEXMAX account, and for keeping your login and device secure. Notify us at support@flexmax.app if you believe your account has been accessed without your permission. One subscription is for one driver; do not share or resell your access.

4. Subscription & billing

4.1 Free trial

New subscribers may be offered a 3-day free trial. Unless you cancel before the trial ends, your subscription will begin automatically and your chosen payment method will be charged the then-current price. You may cancel at any time during the trial to avoid being charged (see Section 5). Trial availability and length may change; the terms shown to you at sign-up apply to your trial.

4.2 Recurring subscription & auto-renewal

FLEXMAX is a recurring subscription that renews automatically. It is billed monthly: your payment method is charged at the start of each monthly cycle until you cancel, and each renewal is for one month. By subscribing, you give express consent to these recurring charges. The recurring amount, frequency, and next renewal date are shown to you at checkout before you confirm.

4.3 Price and currency

FLEXMAX is priced per market:

• United Kingdom — pounds sterling (GBP, £), billed monthly.
• United States — US dollars (USD, $), billed monthly.
• Canada — Canadian dollars (CAD, $), billed monthly.

Prices shown on the site are indicative, not a quote. The exact amount you will be charged — including the currency, billing cycle, and any applicable taxes — is displayed and confirmed at secure Stripe checkout before you agree to pay. The price presented to you at checkout is the price that applies. We do not state a final price as fact anywhere on this site until it is live at checkout.

4.4 Price changes

We may change subscription prices. If we do, the new price will not apply to your current billing cycle. We will give you reasonable advance notice before a price change takes effect on a renewal, so you can decide whether to continue. If you do not want to accept a new price, you may cancel before it takes effect (see Section 5).

4.5 Payments and taxes

Payments are processed by Stripe, a PCI-compliant payment provider. We never see or store your full card details. Your use of Stripe is also subject to Stripe’s own terms and privacy policy. You are responsible for any taxes, fees, or currency-conversion charges that your bank or card issuer applies. If a charge fails, we may retry payment or suspend the Service until payment succeeds.

5. Cancellation & refunds

You can cancel at any time, and cancelling is at least as easy as signing up. You may cancel from within the FLEXMAX app in a couple of taps, or through the Stripe billing portal linked from your account. No phone call, email, or retention process is required.

When you cancel, your subscription stays active until the end of the billing cycle you have already paid for, and it will not renew after that. You keep access to the Service through the end of that paid period.

Refunds. Except where a refund is required by the consumer-protection laws of your country or region, subscription fees are generally non-refundable, and cancelling stops future charges rather than refunding the current period. Where the law gives you a statutory cancellation or “cooling-off” right, that right is not affected by this section. If you believe you were charged in error, contact us at support@flexmax.app and we will review it in good faith.

6. Non-affiliation with Amazon

FLEXMAX is an independent tool and is not affiliated with, endorsed by, or sponsored by Amazon.com, Inc. or Amazon Flex. Amazon and Amazon Flex are trademarks of their respective owners.

Any reference to Amazon or Amazon Flex on this site is for identification and compatibility purposes only and does not imply any partnership, authorization, or approval. FLEXMAX does not act on behalf of Amazon and has no control over Amazon’s systems, offers, policies, or decisions.

7. Account responsibility & use at your own risk

Please read this section carefully. You use FLEXMAX at your own risk, and your Amazon Flex account and everything done with it are your responsibility.

• Automation may conflict with Amazon Flex’s Terms of Service. Using automated tools to find or accept blocks may violate Amazon’s rules and could result in warnings, suspension, or permanent deactivation of your Amazon Flex account. You decide whether to accept that risk.
• No safety or undetectability promise. We make no claim that FLEXMAX is undetectable, “safe,” or that it will prevent action against your account. We do not and cannot guarantee that your account will not be flagged, suspended, or deactivated. Anyone who tells you an Amazon Flex tool is guaranteed safe is not being honest with you.
• No guarantee of blocks or earnings. Block availability, pay, and demand are controlled entirely by Amazon and vary by area, time, and market. FLEXMAX cannot create offers, and we do not guarantee that you will catch any particular block, any number of blocks, or any level of earnings.
• You remain the driver. You are solely responsible for reviewing, performing, and completing any block your account accepts, for meeting Amazon’s requirements, and for complying with all laws that apply to your work, including road, tax, and insurance obligations.

8. Acceptable use

You agree not to:

• use the Service with an account you are not authorized to use, or on behalf of another driver without a separate subscription;
• resell, sublicense, or share your access, or attempt to circumvent subscription or trial limits;
• reverse engineer, decompile, scrape, or interfere with the Service, its servers, or its security, except to the limited extent the law expressly permits;
• use the Service to break any law or any third party’s rights; or
• misrepresent the Service as being provided by, or affiliated with, Amazon.

We may suspend or terminate access that violates these Terms or that we reasonably believe risks harm to the Service or to other users.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will produce any particular result, including catching blocks or earnings. We depend on third-party systems — including Amazon’s platform, your device, your network, and Stripe — that are outside our control, and we are not responsible for their availability or behavior. Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded, including statutory consumer rights.

10. Limitation of liability

To the fullest extent permitted by law, FLEXMAX and its operators will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of earnings, blocks, data, or goodwill, or for the suspension or deactivation of your Amazon Flex account, arising from or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three (3) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing here limits liability that cannot lawfully be limited.

11. Indemnification

You agree to indemnify and hold harmless FLEXMAX and its operators from claims, losses, and expenses arising out of your use of the Service, your Amazon Flex activity, or your breach of these Terms, except to the extent caused by our own fault or where the law does not permit such indemnification.

12. Governing law

These Terms are governed by the laws of [governing-law jurisdiction to be finalized before public launch], without regard to conflict-of-law rules, and the courts of that jurisdiction will have exclusive jurisdiction, except where mandatory consumer-protection law in your country or region gives you the right to bring a claim locally or to rely on the protections of your home jurisdiction. This section does not remove any statutory right you have as a consumer.

13. Changes to these terms

We may update these Terms from time to time. When we make a material change, we will update the “Last updated” date above and, where appropriate, notify you in the app or by email before the change takes effect. If you continue to use the Service after an update takes effect, you accept the revised Terms. If you do not agree, you may cancel as described in Section 5.
